1. Purpose

Purpose of Essay Contest is for Contestants to define and create an urban legend for “Edgar Krawly”, the dark, iconic figure from “Kreepy Krawly’s House of Horrors”.

2. Essay Contest Question & Character Guidelines

Contestant’s Essay will answer as many of these questions as possible:

“Who is Edgar Krawly? Where did he come from? What diabolical deed does he do with all human brains he steals? How does this strange man from circa 1900 - 1920 show up in a modern day “haunted” building? Why do people who enter the “haunted” building see mind-numbing scenes of horror, of every variety?” What is the significance of the cryptic number sequence “29.11”?

1) Established Details. Edgar is approximately 30 - 35, young and cherubic looking man (likely human, but not required). You can find a few pictures of Edgar on the KREEPYKRAWLY.COM website. Edgar’s style of dress and appearance is set around 1900 to 1920 although he exist, in some form, in 2010. You can deviate from these details, but Edgar will always come back to these basic attributes.

Edgar utilizes twisted science and/or arcane scientific apparatus and/or cryptic magic and/or Lovecraftian mythos to allow him to interact with the 21st century. Any other means of handling this subject are also acceptable.

2) Open Details. Edgar could be a magician, a doctor, a scientist, a horror writer, a detective, a comic book writer, a movie director gone astray, a world explorer, a cursed man, a lunatic, a time traveler, a Lovecraftian entity, a Lovecraftian victim, a Captain Nemo, a haunt owner, an alien, a mutant, a monster, Edison gone awry, Nichola Tesla protégé, a parasite, a junk yard owner, a Gypsy, a ghost collector, a side-show operator, a curiosity cabinet proprietor, a museum curator, a member of a secret society, or just a ghost.

Edgar utilizes steam-punk type technology and apparatus and/or Terry Gilliam style technology as visible in the movies “BRAZIL” and “12 MONKEYS”. He could also utilize “alien technology” as if discovered, and expanded upon circa 1880 - 1920.

Edgar enjoys stealing brains from human victims and is adept at stealing them from “yet living” people.

3) “Kreepy Krawly’s House of Horrors” Attraction Details. “Kreepy Krawly’s House of Horrors” will be designed as a giant apparatus, a transmorphing machine whose influence causes victims to witness all variety of horrific visions, typical to haunted house attractions. For whatever reason, Edgar Krawly haunts the building-- Is he flesh and blood, a spirit, some projection from a strange, scientific apparatus?

4) Inappropriate Subject Matters -- Edgar does not utilize any form of Satanic ritual, human sacrifice, demon possession, sex acts, rape, and child molestation or child torture -- Any Essays utilizing such will be disqualified.

3. Prizes

1ST PLACE PRIZE
Cash Prize: A one time cash payment of four thousand dollars ($4000).*

And,

Five (5) percent of Net Profit from "Kreepy Krawly's House of Horrors" or twelve hundred dollars ($1,200) per year, whichever is greater, for a period of five (5) years. Net Profit shall be solely derived from ticket, concession and gift shop sales accumulated in the last seven (7) days of September, the full month of October, and the first seven (7) days of November. Total pay out, including the initial $4000 payment, equals ten thousand dollars ($10,000) over a five (5) year period. Any monies paid to you beyond the initial four thousand dollars ($4000) payment are contingent on "Kreepy Krawly's House of Horrors" completing construction and opening its door for business.

5 Year Honorary Partner. You will be an honorary partner of “Kreepy Krawly’s House Of Horrors” for 5 years allowing you and a guest free admittance to the attraction during it’s season of Halloween operation, behind-the-scenes access, workshop visits and hanging with “Kreepy Krawly’s” build and FX crew to see first hand how the attraction is created (at the discretion of “Kreepy Krawly’s” Creative Director). You will be responsible for all travel and accommodation expenses associated with these visits.

Kreepy Krawly’s Victim. Hollywood make-up FX artists will create a life-size dummy of you, featuring an ultra-detailed copy of your head. Your likeness will be displayed at the interior entrance of “Kreepy Krawly’s House of Horrors” making you Edgar Krawly’s first visible victim. Promoter will cover all travel expenses and accommodations required to make a life-cast** of your head. Upon completion of sculpture and its molding by our artists, you will receive a plastic, bronze painted copy of your and Edgar Krawly’s head.

Rotting Flesh Radio Appearance and Essay Reading. You will be featured on RFR as a guest for an exclusive interview and your story will be professionally read on the show with sound FX added.

Robert Kurtzman’s Creature Corps. Reproduction Prop from “The Rage”. -- You will receive a Robert Kutzman autographed, soft urethane reproduction bust of “GOR” the hideous ghoul from “The Rage”.

Midnight Syndicate “The Dark Matter” Prize Pack (all autographed) -- A DVD copy of “The Dead Matter”, a CD copy of “The Dead Matter” original soundtrack, and a CD copy of “Midnight Syndicate 13th Anniversary: Halloween Music Collection” (a “best of” for Halloween).

Your Written Walk-on Death In A Novel By A “Bram Stoker Award” Winning Author. A character will be named after you and killed off in a future novel by your choice of horror author Brian Keene (The Rising, City of the Dead, Dead Sea, and Urban Gothic) or by horror author Jonathan Maberry (Ghost Road Blues, Dead Man’s Song, Bad Moon Rising, and Patient Zero). You must sign a release for your name to be used.

13 Finalist’s Prize Package -- As one of the 13 Finalists you will also receive the 13 Finalist’s Prize Package.


2nd PLACE PRIZES

Robert Kurtzman’s Creature Corps. You will receive a $150 gift certificate good for any of the fantastic items in the “Bob Kurtzman’s Creature Corps.” catalog.

"GOLDEN STINKER AWARD"
The “Golden Stinker Award” will be given to one (1) Contestant who exhibits the “worst, best effort” and because we like the underdog, the “Golden Stinker Award” winner gets a check for $100. We will not publicly announce you as the “Golden Stinker Award” winner unless you first give us your explicit and written permission.


*Cash prize awards will be paid in the form of cashier's check payable to Winner only, and not in actual Federal Reserve notes or any other currency. Please read section titled “Opening, Deadline and Ending of Contest” for additional details pertaining to cash prizes.

**Promoter is not responsible if Winner is unable to physically or psychologically sit through the head casting process, and shall have no further obligation to create a “dummy head” likeness of Contestant nor compensate Contestant in any other manner for loss of this prize.

4. Contest Procedure

Upon receiving required number of Contestants, Promoter Judges shall read all properly submitted, 500 words or less Essays and, by process, determine thirteen (13) Contestants to be Thirteen Finalists. Thirteen Finalists will be notified by phone and Email that they are a Finalist, and shall be given at least seven (7) days to edit, amend or modify their Essay, in any manner chosen, to a maximum length of up to 1000 words. Essay shall be returned to Promoter by date required and copies of Essays shall be delivered to each member of Celebrity Judge Panel. Celebrity Judges shall determine, by process, a 1st Place Winner, 2nd Place Winner and “Golden Stinker” Winner shall be chosen and notified by phone, email, certified mail and by posting Winner’s names on the KREEPKRAWLYS.COM website.

5. Eligibility

Contestants must be at least 18 years or older at the time of Essay submission. Essays submitted by Contestants who are under 18 years of age must be co-signed by their Legal Guardian and to assure this we ask that you mail your Entry Form, Essay, and Payment to us instead of electronically entering Essay Contest.

Contestants must submit a completed, legible entry form, a 500 words or less in length and pay a contest entry fee of $29.11 US for each Essay submitted.

An individual may enter Contest as many times as desired, however each entry must include a new entry form, a new, original Essay and pay an additional $29.11 US Entry Fee for each Essay submitted.

Promoter and Judges, as well as their immediate family members and residents of their households, are ineligible to enter Essay Contest.

Promoter reserves right, exercisable in its sole discretion, to disqualify any Contestant it finds has: (1) violated these Official Contest Rules; (2) interfered with, or attempted to manipulate, the Contest results; (3) violated any law or regulation by participating in the Contest; (4) provided false information to Promoter.

Promoter has attempted to comply with all legal requirements in constructing Contest. Shall any governmental entity determine that a Contestant has violated applicable laws or regulations, Promoter shall have the option, in its sole discretion, to disqualify Contestant.

Void where prohibited. Promoter makes no representation regarding accessing materials on this website from jurisdictions where its contents or Contest are illegal or prohibited. Users who choose to access this website from other locations do so at their own risk and are responsible for compliance with local laws and regulations.

6. Essay Technical Requirements

Eligible Contestants must meet the following Technical Requirements:

1) Submit an Essay, not to exceed 500 words, hand-written or typed, in English. Essay must be legible.

2) A properly signed or electronically submitted Entry Form, including a Legal Guardian’s signature for Contestants under 18 years of age. If under 18, we require that your Legal Guardian also sign the Entry Form, and to assure this we ask that you mail your Entry Form, Essay, and Payment to us instead of electronically entering Essay Contest.

3) Include a $29.11 US Entry Fee made payable to Spook House Logistics, Ltd, via money order or bank check. You can fill out the Entry Form, pay the $29.11 Entry Fee and type or “cut-and-paste” your Essay into our system via our online Registration and Shopping Cart system.

4) Essays written over 500 words in length, or containing personally identifying information within the story, shall be disqualified, and Entry Fee forfeited.

5) Essays using Satanic ritual, human sacrifice or torture porn, demon possession, sex acts, rape, child molestation or torture, or actual witchcraft, shall be disqualified, and Entry Fee forfeited. If you have any question as to the appropriateness of your subject matter you wish to write about, you may inquire about such by emailing

Essays, entrance forms, and electronic payments submitted electronically via our website qualify as an “Electronic Signature” within the meaning of 15 U.S.C. 7001(B)(2), thereby binding Contestant to Official Contest Rules.

7. Entry Notification

Upon successful receipt of your Essay, we will send you a receipt / confirmation email including your unique identifying number. If you would prefer to receive notification by mail, please include a Self-Addressed-Stamped-Envelope.

8. Opening, Deadline, and Ending of Contest

Contest is open from January 16th, 2010, 9:59:33 p.m. Eastern Time and will continue until June 16th, 2010 9:59:33 p.m. Eastern Time. Essays postmarked on or before June 16th, 2010 will be accepted after June 16th, 2010.

Contest must receive a minimum of 4000 Essays postmarked by June 16th, for Contest to proceed. The number of Contestants will be tracked on the KREEPYKRAWLY.COM website up to the 4000 entries mark so Contestants will know when the Essay Contest can proceed without delay.

In the event that the 4000 Contestant goal is unmet, Promoter reserves the right to extend the length of Contest’s Open Entry period by up to one hundred and twenty (120) days or to reduce number of required Contestants.

If, after an extension period, the required number of Contestants still has not accumulated to at least 4000 Contestants, the Contest will still operate, however, the money portions of the 1st and 2nd Place Prizes will be reduced to a one time payment of two thousand dollars ($2000) for First Place and five hundred dollars ($500) for Second Place. All other prizes will remain the same.

Promoter reserves the right to end Contest early and to begin Judging process when, at any time during open Contest period, sixteen thousand (16,000) Essays are received.

Promoter reserves the right to end Contest early in the event of unforeseen circumstance such as a natural disaster, illness, death or any other circumstance occurring outside of Promoter’s control, that would, in Promoter’s sole discretion, compromise Contest.

9. Contestant’s Anonymity During Judging

For the integrity of the Contest, identity of all Contestants will remain anonymous to Judges until all Winners are officially selected, declared and announced. This will be achieved by assigning each entry a unique entry number upon receipt of each eligible entry. This unique number will be attached to both Entry Form and Essay. Essay will be photocopied, and no personally identifying information of Contestant will remain on Essay, just the unique number.

10. Originality of Essay, Copyright & General Release

Essay must be the original creation of a sole Contestant, specifically written for this Contest, and must not infringe upon the rights of any other person or entity. Contestant represents and warrants that (1) you have the legal right and authority to grant the rights set forth in our terms and rules, (2) neither Essay nor exercise of the rights granted to us, under our Official Contest Rules, including, without limitation, the public display, public performance, distribution, or reproduction of Essay, or portions or derivative works thereof, will violate or infringe upon the copyright, literary, privacy, publicity, trademark, service mark or any other personal, contractual or property right of any person or entity anywhere in the world, and (3) Essay does not and will not violate any applicable laws, and is not and will not be defamatory, libelous, pornographic, or obscene.

By participating, Contestants agree to be bound by these Official Contest Rules, including all eligibility requirements as stated herein and elsewhere. By entering Contest, you consent to Promoter’s use of your name, essay, or likeness, for promotional purposes in connection with Contest and the promotion and marketing of “Kreepy Krawly’s House of Horrors”, without any compensation or royalties.

“Edgar Krawly” is the copyrighted, trademark pending character of David Barton. Contestant’s Essay, being exclusively written about “Edgar Krawly” and “Kreepy Krawly’s House of Horror”, shall become the sole, exclusive property of Promoter, who has licensed those names from David Barton. Accordingly, Promoter shall have any and all rights to exploit your written Essay, including the ability to copyright such under its name. Contestant acknowledges that their Essay may be adapted, revised, edited and/or combined with other works. Contestant waives any and all so-called moral rights of authors, or “Droits Morale”, applicable in any jurisdiction. Contestant hereby grants and assigns to Promoter all right, title and interest to the Essay, throughout the universe, for perpetuity, to the extent these provisions do not otherwise grant to Promoter all of such right, title and interest and in the event that these provisions are not deemed effective for such waiver.

Contestant acknowledges that, although they are writing the story and profile of an existing character for possible inclusion in the marketing of a haunted house attraction, Promoter is in no manner bound to use any of Contestant’s Essay, even if Contestant’s Essay wins.

Contestant acknowledges that their Essay, although original to Contestant, may have already been similarly conceived of by Promoter, or may have been similarly conceived of and written by other Contestants.

Neither Contestant’s participation in this contest nor any exploitation of Contestant’s essay by Promoter shall confer to Contestant any right to any compensation or royalties, beyond those explicitly stated herein, nor shall such be deemed to constitute either party a partner, joint venture or employee of other party for any purpose.

Contestant acknowledges that their Essay will not be returned to them.

11. Judges & Judging Criteria

Panel of Judges is comprised of a diverse group of unbiased individuals and their experience, education, and creative talents have all been considered in the process of their selection. To protect integrity of Contest, identities of Panel of Judges will not be made public.

Promoter reserves right to remove and replace a Celebrity Judge at its sole discretion.

Essays will be divided amongst a Panel of Judges comprised of Promoter associates and scored using following criteria:

1. THEME (a score of 1 to 20) Theme is scored on how well your concept answers our questions.

2. CREATIVITY (a score of 1 to 20) Creativity is scored on the freshness or novelty of your idea, your ability to transcend traditional ideas, and to create meaningful new ideas and re-interpretations of old ideas.

3. INTERESTING (a score of 1 to 20) Interesting is scored on how engaging or exciting your idea is and its ability to hold reader’s attention or curiosity.

4. STYLE (a score of 1 to 10) STYLE is scored on how distinctive your mode of writing is, how well you express your ideas clearly and effectively through careful selection and use of words.

5. SPELLING / GRAMMAR (a score of 1 to 5) We love spelling and grammar, however, your creativity is more interesting to us and we don’t want to discourage people with great stories to tell.

Panel of Judges will score their assortment of essays, using the above criteria, and from that, to choose their top three (3) Essays. Each Judge will then receive copies of these Essays to rescore, and top thirteen (13) Essays will become “Thirteen Finalists”.

Thirteen Finalists will be given the opportunity to expand their Essays to a length of 1000 words or less. These Revised Essays will be assigned a number from 1 to 13 and a copy of every Revised Essays will be given to every Celebrity Judge to score utilizing the same established criteria. From these scores, First and Second Place Winners will be chosen. In the unlikely event of a tie, the President and Treasurer of Spook House Logistics, Ltd. and “Kreepy Krawly’s House of Horrors” Manager will cast deciding votes.

12. Winner Notification

Winners will be determined and notified within ten (10) days of Celebrity Judge’s determinations. Notification shall be via E-mail, telephone call or certified mail from information provided on Entry Form. Additionally, names of the 13 Finalists and the First and Second place Winners will be displayed on KREEPYKRAWLYS.COM.

13. Prize Claimant

Potential winner(s) shall be given ten (10) business days from the time they are “Officially Notified” (via email, phone call or certified mail), to respond and claim prize, and upon any failure to do such, an alternate winner will be chosen. Conditional of prizes being awarded, potential winner(s) are required to sign a notarized affidavit of eligibility, publicity and liability release, plus a notarized affirmation that Contest submission was their own sole creation, and return it properly executed, within ten (10) business days from date potential prize winner responds to claim awarded prizes. If a potential winner fails to return affidavit and affirmation as specified, that potential winner will be disqualified and an alternate winner will be selected.

14. Other Rules and Conditions

By entering Contest, each Contestant accepts and agrees to be bound by these Official Contest Rules and decisions of Promoter and Judges. Promoter and its agencies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur while processing Essays.

Promoter and its agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.

Promoter and its agents / agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or any combination thereof, including injury or damage to Contestant or to any person's computer related to, or resulting from, participating or downloading materials from KREEPYKRAWLYS.COM.

Promoter is not responsible for any late, lost, misdirected, incomplete, illegible, or destruction of entries due to circumstances beyond their control. Essays disqualified for not following Essay rules and guidelines, noted above, will not be eligible for refund. Essays received late or incomplete may be voided and disqualified. Essays are considered void if illegible or damaged. No refunds shall be given for any reason. No Essays shall be returned for any reason. Do not send original copy.

If, for any reason, Contest is incapable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any causes or reason beyond the control of Promoter, which corrupts or affects the administration, security, fairness, integrity or proper conduct of Contest’s Sponsors, reserve the right to terminate, modify, or suspend the Contest without liability to any Contestant. Contestant is solely responsible for all submission content that you submit or otherwise make available through Contest entry. Promoter may change or alter Contest rules for better clarification if deemed necessary.

Winners are responsible for any and all applicable local, state and federal taxes associated with any prize awarded. Questions related to tax liability should be directed to a qualified tax advisor.

Promoter reserves the right to amend these rules at its sole discretion and once amendments are posted on website they become final and effective the day of posting. This entire agreement becomes void where prohibited by law and there are no warranties, promises or agreements, oral or implied, except where stated herein.

Promoter has made every effort to present this Essay Contest as accurately as possible, however, documents and related graphics published on this server may include technical inaccuracies or typographical errors which Contestant agrees Promoter is not liable for.

15. Essay Contest Defined

Contest contains no element of chance, it is a “game of skill”, judged on Contestant having first met certain technical requirements, and then, judged on Contestant’s creativity, originality and writing skills. There are no “odds” of a particular Essay being chosen by Judges or prizes being awarded.

16. Governing Authority & Limitation of Liability

All federal, state and local laws and regulations apply. Void where prohibited. While KREEPYKRAWLYS.COM website can be accessed from anywhere, Promoter’s offices and the legal, physical location of contest are in state of Ohio.

Any dispute between Parties arising out of, or relating to, this Agreement shall be submitted to binding arbitration. Arbitration will be conducted in accordance with the American Arbitration Association's Commercial Arbitration Rules as modified by the terms of this Agreement. Arbitration shall take place in Stark County, Ohio before a single arbitrator, selected pursuant to such rules, and shall be conducted on an expedited basis and in strict confidence. Arbitrator selected pursuant to these Official Contest Rules shall be well acquainted with entertainment, Internet, and new media industries, and shall not have the power to impose punitive damages. Each party hereby waives any and all rights and benefit of which it might otherwise have or be entitled to under federal law or the laws of Ohio or any other state to litigate any such dispute in court, it being the intention of the parties to arbitrate all such disputes. Arbitrator's decision shall be controlled by the terms and conditions of these Official Contest Rules, and any other agreements the applicable Contestant may have entered into with Promoter in connection with Essay Contest, and shall be final and binding, and shall provide for each party to bear its own costs of arbitration and attorneys' fees. Both parties expressly waive any right to a jury. Judgment, upon award of by Arbitrator, may be entered or enforced in any court of competent jurisdiction. Shall either party fail to appear at hearing on date designated in accordance with the rules of the American Arbitration Association, or shall otherwise fail to participate in arbitration proceeding, arbitrator is hereby empowered to proceed expiate. In the event of any dispute concerning these Official Contest Rules, or any other agreement between the applicable Contestant and Promoter in connection with Essay Contest, Contestant's sole and exclusive remedy shall be to seek damages pursuant to an arbitration authorized by this Paragraph, and in no event will any Contestant be entitled to seek injunctive or other equitable relief.

Contestant hereby agree totally, irrevocably, unconditionally to waive any defense of inconvenient forum to any action to be heard in the state of Ohio.

In the event Contest is challenged by any legal authority, Promoter reserves the right to discontinue or modify Contest, or to disqualify Contestants residing in affected geographic areas. In such event, Promoter shall have no liability to any Contestant who is disqualified due to such an action.

By entering Essay Contest, Contestant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Essay Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Essay Contest, but in no event will attorneys' fees be awarded or recoverable; and (3) under no circumstances will any Contestant be permitted to obtain any award for, and Contestant knowingly and expressly waives all rights to seek punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased.

Contestant acknowledges and agrees that Promoter is not responsible for any losses, costs, losses, or damages of any kind arising from, or in connection with,: (1) incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to any cause, including without limitation human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, with Promoter, or otherwise, that may limit a Contestant's ability to participate in the Essay Contest or send or receive email notifications requiring action or response by such Contestant; (2) any injury or damage resulting from participation in the Essay Contest and/or the use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the Contestant's rights of publicity or privacy, or the Contestant's claim that he or she has somehow been defamed or portrayed in a false light).

If you do not agree to these requirements, do not participate in Essay Contest.

17. Severability And Headings

Shall any court find any provision of these Official Contest Rules to be illegal, invalid or unenforceable, such provisions shall be severable, and the remaining Official Contest Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

Headings and captions are used in these Official Contest Rules are solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Contest Rules or any provision hereof.
